Yuma Business Owner Pleads Guilty to Employment Tax Evasion

PHOENIX, Arizona — Philip Kevin Clark, a 61-year-old resident of Yuma, Arizona, pleaded guilty on April 15, 2025, to Failure to Pay Employment Taxes. Clark, the owner of a water company in Yuma, admitted to withholding $395,250 from his employees’ paychecks between 2017 and 2021, funds intended for taxes that he failed to remit to the Internal Revenue Service (IRS). His sentencing is scheduled for July 28, 2025, before United States District Judge Steven P. Logan.

Court documents reveal that Clark deducted the taxes from his employees’ wages over the four-year period but did not forward the money to the IRS, violating federal tax laws. The significant amount—$395,250—highlights the scale of the evasion, which impacted the financial obligations of his water company and its employees. A conviction for Failure to Pay Employment Tax carries a maximum penalty of five years in prison and a $250,000 fine, reflecting the severity of the offense.

The investigation was conducted by the IRS Criminal Investigation Phoenix Field Office, which worked to uncover the extent of Clark’s tax evasion. Assistant U.S. Attorney Kevin M. Rapp, from the District of Arizona in Phoenix, is handling the prosecution, ensuring that Clark faces the consequences of his actions.
